Welcome to QueAah("QueAah," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our QR menu management platform, administrative dashboards, API integrations, and public diner-facing menu pages (collectively, the "Services").

By signing up for an account, accessing a workspace, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Account Registration and Workspace Access

To utilize the QueAah platform, you must create a workspace account by providing accurate and complete information:

  • You must maintain the confidentiality of your credentials and restrict access to your account. You accept responsibility for all activities that occur under your account.
  • Workspaces are managed in a hierarchical structure (Owners, Managers, and Staff). Owners and Managers are solely responsible for adding or removing team members, assigning appropriate roles, and ensuring compliance with these Terms.
  • We reserve the right to suspend or terminate accounts that violate these Terms or present security risks to our infrastructure.

2. Subscription Fees, Billing, and Cancellations

QueAah offers paid subscription tiers for advanced menu items, multiple branch locations, and customized branding palettes:

  • Billing: Fees are billed in advance on a recurring monthly or annual basis. You agree to provide valid billing information. Payments are processed securely via our third-party processor (Stripe).
  • Cancellations: You can cancel your subscription at any time within your billing settings. Upon cancellation, your workspace features will remain active until the end of your current paid period.
  • Refunds: Unless explicitly stated or required by applicable law, all subscription fees are non-refundable.

3. Acceptable Use Policy and link integrity

You agree not to use the Services to distribute illegal content, coordinate fraudulent dining schemes, or execute malicious actions:

  • Menu Authenticity: You must ensure that pricing, menu descriptions, and dietary declarations (such as allergy designations) are accurate. QueAah is not liable for diners' dining decisions or health reactions.
  • Reverse Engineering: You agree not to attempt to reverse engineer, decompile, or bypass security features (such as table-specific QR tokens) to scrape our databases or spam endpoints.
  • QR Tampering Defenses: Each table QR code incorporates an unguessable randomized token. Any intentional tampering, guessing, or automated scanning of these routes to generate fake metrics or scans is a direct violation of these Terms and will result in immediate API access blocking.

4. Intellectual Property

As between the parties, QueAah retains all rights, title, and interest in and to the Services, including our software, logos, trademarks, database schema layouts, and custom visual templates.

You retain all rights to the raw content (menu descriptions, brand names, and photos) uploaded to your workspace. By uploading content, you grant QueAah a worldwide, royalty-free, non-exclusive license to host, parse, copy, and display that content solely to make the public menu accessible to your diners.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUEAAH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICES.
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
  • ANY SERVICE INTERRUPTION, NETWORK OUTAGES, OR DOWNTIME AFFECTING DINER ACCESS TO MENUS.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QueAah operates, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts located in our home jurisdiction.
